ROAN Member of Parliament (MP) Chishimba Kabwili has objected to having his writ of summons in which he is challenging his expulsion from the Patriotic Front (PF) being set aside because of irregularities.
Mr Kabwili has argued that the irregularities cited in the summons had been amended and now everything was correct.
The PF had, through its lawyers Eric Silwamba, Jalasi and Linyama Legal Practitioners, urged High Court Judge Petronella Ngulube to set aside Mr Kabwili’s summons, citing irregularities.
But in his affidavit-in-opposition, Mr Kabwili said the irregularities which were being referred to by the PF had been rectified through the amended summons.
Mr Kabwili said as far as he was concerned, the irregularities claimed by the PF could no longer be justified.
He said matters raised in the notice to raise preliminary issues had already been attended to and cured through the amended writ of summons which he had filed in court.
Mr Kabwili, who is former Information and Broadcasting Services minister, said that further to the filing of the amended writ of summons, the notice of appointment of an agent within a radius of 10 kilometres from the High Court principal registry had also been done.
He argued that the commencement of the action through the writ of summons was proper as he was merely challenging his expulsion from his political party, which was a private matter and had nothing to do with the Constitution of the Republic of Zambia.
In this matter, Mr Kabwili is challenging his expulsion from the PF for alleged misconduct.
Ms Justice Ngulube adjourned the case to October 27, 2017.
