RAINBOW Party president, Wynter Kabimba and his co-accused Post Newspaper editor-in-chief Fred M’membe, have been found with a case to answer in a matter they are charged with contempt of court.
Lusaka principal magistrate Kenneth Mulife said in his ruling yesterday that the prosecution has established prima facie cases against ?all the three accused persons.
“I, therefore, put the accused persons on their defence on both charges,” Mr Mulife said.
Mr Mulife had since placed the three on their defence to answer to the charges.
Kabimba, the former Patriotic Front (PF) secretary general and former Justice minister and M’membe who was also appearing on behalf of the Post Newspaper, were facing criminal libel and contempt of court in relation to a published article concerning former Republican President Rupiah Banda.
The article was entitled ‘Lungu is framing Nchito to cover Rupiah’s criminality – Kabimba’, and was published in The Post Newspaper of February 13, last year.
One of the defence lawyers, Nchima Nchito, informed the court that Kabimba and M’membe would testify on oath.
They will open their defence on December 14, this year.
