THE Zambia Agency for Persons with Disabilities (ZAPD) has sued a Lusaka-based company, Heritage Trails, for alleged nonpayment of rentals since June 24, 2013 to date at a monthly cost of K1,300.
The Agency stated that the property was leased out on October 1, 2010 and the defendant had been paying except from June 24, 2013 when the company allegedly started defaulting.
The plaintiff complained that several notices had been given to the company to vacate the premises which were being rented out to raise resources for the disabled.
In a statement of claim filed in the Lusaka High Court, the plaintiff is now asking the court to order for an eviction notice since Heritage employees have refused to accept the final eviction notice from the Agency.
“By a lease agreement dated October 1, 2010, the plaintiff herein leased unto the defendant a business premises plot number 488a/ 8/a Kabulonga at an agreed rental of K1,300 per month but since July 2013, the company has refused to pay anything,” read the affidavit.
The defendant is now asking the court to also order for the recovery of arrears in rent from the months it started defaulting to date plus interest at the current bank rate.
“We seek the court’s intervention to order for recovery of the demised premises in Kabulonga and another order of the recovery of arrears in form of rentals and an issuance of notice to vacate the said premises,” the affidavit stated.
