A SIXTY-FIVE-YEAR-OLD farmer of Kabwe, alleged to have defiled his 14-year-old granddaughter, has denied the charge informing the court that his sexual organ stopped functioning in 2008.
Simon Kalangwe, a farmer with two wives, is facing one count of defilement, an offence he allegedly committed on July 13, this year. He is appearing before principal resident magistrate John Mbuzi.
Kalangwe informed the court that he had no ability to have sex because his organ stopped functioning in 2008.
Kalangwe said in his defence that since 2008 he developed a condition that did not allow him to have sex.
When the case came up last time Kalangwe had informed the court that he would present the medical forms to prove that his manhood did not function.
He said he had been receiving treatment from a clinic for his condition and asked the court to release him so he could collect the medical reports.
When the case came up on Monday he said the clinic was closed when his children went to get the medical forms.
Kalangwe said he needed more time so that he could be tested from another hospital and be able to bring to court the evidence that he was in no condition to have sex.
The court advised Kalangwe to be serious as the charge he was facing carried not less than 15 years in jail.
He has since given Kalangwe seven days in which to prove to court that he did not defile the girl.
Mr Mbuzi set August 24 for continuation of defence and August 28 for judgment.
