THE Kitwe High Court has slapped a 10 year jail term on a 21-year-old man who attempted to rape a trader.
High Court Judge -in-charge Catherine Makungu sent Nason Banda to jail after she confirmed his conviction by the lower court.
Banda was charged with attempted rape after he wanted to have sex with a 45-year-old woman without her consent on January 31, 2012.
The victim had testified that on the material day, she was in the company of her friend going home from Nakadoli market, when they met Banda.
She told the court that
Banda tried to grab her friend, but she managed to flee from him and that was how he turned on her.
The court heard that Banda held the victim tightly by the waist and when she asked him why he was doing that, he informed her that he wanted to marry her daughter.
She testified that she told Banda that there was no way he could marry her daughter because they had a similar surname.
The accused person however, responded that he would then marry the victim instead and started fondling her.
She testified that she started shouting for help and in the process of struggling with Banda, she fell and hurt herself.
In mitigation, Banda, through Legal Aid Principal advocate Ignatius Chongwe asked for the courts leniency because he had learnt a lesson since his incarceration in 2012.
