By PERPETUAL SICHIKWENKWE –
CHIEF Justice, Irene Mambilima has said the tribunal constituted by President Edgar Lungu to probe the alleged misconduct of suspended Director of Public Prosecution (DPP), Mutembo Nchito has experienced legal brains that will discharge duties with impartiality.
Meanwhile, the proceedings of the tribunal will be held in camera.
Ms Justice Mambilima was convinced that the team comprised the best and experienced legal brains who have served at the highest level of the judiciary to discharge their duties in a fair and impartial manner and accord all the parties concerned a fair hearing.
She said there was a lot of public interest concerning Mr Nchito’s alleged misconduct hence the setting up of the tribunal to investigate him.
Ms Justice Mambilima said this yesterday when she swore-in the four-member tribunal team led by former Chief Justice Annel Silungwe.
Other members include former Chief Justices Mathew Ngulube, Enerst Sakala and High Court registrar, Mathew Zulu as secretary.
In the recent past, the constitutional office of the DPP came under intense debate which also saw citizens go to court to have Mr Nchito tried on various charges.
Ms Justice Mambilima said the operations of the tribunal were in accordance with Article 58 of the Constitution and assured the nation that all the parties concerned would be afforded a fair hearing.
The tribunal whose date of commencement would be announced soon, would go ahead following High Court judge, Mwila Chitabo’s decision last Friday, to discharge the stay earlier granted to Mr Nchito to block the decision to suspend him and set up a tribunal to probe his alleged misconduct.
Mr Lungu has spelt out eight terms of references which Mr Justice Silungwe and his team would base their investigations on.
Mr Zulu said in a statement that the tribunal would be held at Mulungushi International Conference Center (MICC) but it will not be open to members of the public.
