THE KABWE High Court has acquitted a 19 year old man of murder following the prosecution’s failure to prove the case beyond reasonable doubt.
Andifai Miti was accused of being behind the gruesome killing and setting ablaze of three children and a woman in Chisamba, which he denied.
On December 18,2012 in Chisamba, Miti allegedly murdered Hildah Kapandula 57,Lute Kapandula 10,Chanda Chungu 12 and Loveness Kachema 9 all of Katalala village in Chipepo area.
In passing judgment Kabwe High Court Judge in-charge Mwiinde Siavwapa said there was no evidence linking Miti to the crime as there was no medical proof to show that the deceased were killed before they were set ablaze.
Mr Justice Siavwapa said there were no witnesses to prove that Miti murdered the deceased and all the evidence in court was purely circumstantial.
It was unfortunate that a family could be brutally murdered in their home without anyone knowing about it.
Mr Justice Siavwapa said he had acquitted Miti on grounds of insufficient evidence against him and cleared him of all charges.
During trial a number of witnesses were brought in among them a police officer George Banda from Chisamba who told court that he visited the scene of the incident.
Mr Banda said he recorded a warm and caution statement in which Miti denied the charges but admitted having differed with Ms Kapandula the deceased.
