THE Supreme Court has adjourned the appeal case in which former Sports Deputy Minister Stephen Masumba has appealed against a 12-month jail sentence against him, to March next year.
Masumba, who is also Mufumbwe Member of Parliament (MP), appealed against his conviction by the lower court saying it erred in law.
The Lusaka High Court in September, this year upheld the appellant’s 12-month jail term by the magistrate court.
Supreme Court Justice Muyinda Wanki sitting with Justices Elizabeth Muywove and Mumba Malila in Ndola granted an adjournment application by the appellant’s Lawyer Mutakela Lisimba.
When the matter came up for hearing yesterday, Mr Lisimba asked the court to adjourn the case saying he did not receive instructions to proceed with the matter.
He told the court that the other reason he could not proceed was that the records of appeal did not show the exhibits produced in the subordinate court.
Justice Wanki granted the application though it was wrong for the defense lawyer to want to put exhibits that were produced in the subordinate on the record of appeal.
He, however, adjourned the case to March Next year, in the Ndola session and advised Masumba’s lawyers to take note of the errors highlighted on the grounds of appeal.
