Man jailed for defiling niece

A MAN who feigned sexual impotence to escape being jailed for defiling his eight-year-old niece, has been sentenced to 25 years in prison after a medical examination at Kasama General Hospital certified that his manhood were functioning normally.
The victim, had many times reported to her parents that Christopher Bwalya, her father’s brother, had been having sexual intercourse with her but the girl’s story was rebuffed and asked not to scandalise her uncle.
High Court Judge Charles Chanda said even though Bwalya had pleaded for leniency as a first offender, there were aggravating circumstances in the matter as he was the victim’s uncle and breached the trust conferred upon him.
An eye witness Kelvin Mulenga testified in court how he left home around 07:00 hours in the morning on October 3, 2012 to pursue debtors in Ngoli Village.
He narrated how he got to Bwalya’s sister-in-law’s house and found two children at home that told him that their parents had gone to Nseluka Village.
As he was living he passed behind the house where he found Bwalya on top of the girl with his shorts pulled down.
When he saw there was a spectator, Bwalya immediately pulled the shorts up to his waist.
Mulenga asked Bwalya what he was doing and Bwalya retorted that there was nothing he could do with the girl because she was his brother’s daughter.
On inspection, the girl’s dress and underpants were found to be torn.
Mulenga then rallied up other members of the community that apprehended Bwalya and took him to the police station.
In his defence, Bwalya claimed he could not have defiled his niece because he was impotent which prompted the court to order a medical examination
The medical examination, however, proved him wrong as his penis was found to be functioning normally.
