A NDOLA magistrate’s court has found a 22-year-old man guilty of defiling a six-year-old girl.
Magistrate Misozi Banda convicted John Chikuta, a farmer of unknown address, of defiling a six-year-old girl who happens to be his grand child.
Facts of the case are that Chikuta on May 25, this year defiled the six-year-old child.
The grandmother of the child, testified in court that on May 25, this year she had travelled to Kitwe to nurse a sick relative and had left the child at her house in Kaniki Township.
She was then informed that her grand daughter had been defiled.
On May 27, this year when she returned to Ndola, she was told that her brother, Chikuta, had given the child 20 Ngwee and bought her a fritter after which he defiled the girl.
The mother of the girl testified that she had sent her daughter on holiday to her mother’s house in Kaniki area and that she was informed on May 26, this year that her daughter had been defiled.
The girl’s mother said that the next morning, she went to her mother’s place and checked on her daughter and found that there were blood stains on her trousers.
The matter was then reported to Kaniki Police Post where she was issued with a medical report.
In the company of police officers, the child was taken to Arthur Davison Children’s Hospital where they confirmed that she was defiled.
Chikuta agreed that he had given the child a 50 Ngwee to buy a fritter but did not have sex with the child.
Chikuta told the court that on the said date he went to the sister’s house to pick up his clothes and spent the night there but that he did not defile the girl.
After considering the evidence, Ms Banda convicted Chikuta of defilement and referred him to the High Court for sentencing.
