THE Lusaka Boma Local court has heard how a woman of John Laing Township ran away after her husband found her having sex with another man in a bathroom.
Ernest Chama, 40, told the court that in June last year, he caught his wife having sex with Frank Chibuye, 28, also of John Laing Township after a tip off from his children that his wife was having an extra marital affair.
This was a case where Chama sued Chibuye for adultery after he allegedly found him having sex with his wife Nwela Mutale in the couple’s bathroom.
Facts before the court were that Chama and Mutale were married in 1991 and have seven children but in June last year, Chama found his wife Nwela, having sex with Chibuye in the couple’s bathroom after a tip off.
Chama told the court that he was on several occasion told by different people that his wife was having a love affair but he never believed because he trusted his wife so much.
When rumours persisted he decided to lie to his wife that he was going to Kabwe when in fact he was just within Lusaka so that he could catch the wife off guard.
Chama said he managed to catch the two although both of them ran away where they went to stay together to unknown place.
“From the time I found my wife having sex with this man, she deserted the matrimonial home and went to stay with Chibuye,” he said.
In his defence Chibuye admitted that he had sex with Mutale but told the court that she did not tell her that she was married.
He submitted that Mutale was just a woman he considered a sex worker because he met her in a bar adding that he had no plans to marry her.
Chibuye said she was forced to stay with Mutale after the two were caught because she insisted despite being asked to leave him alone.
“I was just helping his wife because she kept on following me after the incident and told me that she was not married and had no place to stay,” he said
In her submission, Mutale told the court that she was not the one who decided to desert her matrimonial home but her husband who chased her after being caught having sex with Chibuye.
She also defended Chibuye saying he could not be blamed for staying with her because it was actually herself who had pleaded with him to live with him after being chased away by the husband.
The matter was since adjourned to August 22, for judgement.

A MAN of Lusaka’s Manda Hill area has asked the Boma Court to grant him divorce after accusing his wife of searching his cell-phones.
Richard Muzeshe said his wife Lyness Chisanga was so obsessed with jealous that she suspected him of having girlfriends.
This was in a case where Muzeshe, 36, sued Chisanga,29, for divorce after being on separation for seven months.
Muzeshe told the court that although they had been married for seven years, his wife did not trust him and always searched his phones and called any number she suspected was for his girlfriend to insult them.
He said his wife did not have respect for him to the extent that she had been telling the children that he liked sex workers.
Muzeshe told the court that she also told him that he was impotent and it was her who gave him the medicine to enable him have children.
“She is too jealous and has no respect for me, she says I am impotent and that if she did not give me medicine, I wouldn’t have had children yet, I already had a child when I married her. She even told my children that I like prostitutes,” Muzeshe said.
However, Chisanga told the court that her husband was always found with a female workmate she suspected was his girlfriend.
Chisanga told the court that her husband was insulted her in the presence of the children while he moved out of the bedroom and sleeps in the living room.
She told the court that she left the matrimonial home so that she could be near people as she was usually left alone at home but that the husband did not follow her.
Magistrate Mundia Banda granted divorce and ordered Muzeshe to compensate Chisenga with K5,000.

‘I want a share of my late son’s estate’

A MAN of Lusaka’s Chipata Township has asked the Lusaka Boma Local Court for consideration in his late son’s estate after his grandson asked for revocation of the administrator.
Steven Mwendachabe told the court that he had not received any share of the property that was left even when he was entitled.
This is a case where Mwendachabe, 70, was sued for revocation of order of appointment by his grandson Chad Mwendachabe, 24, who claimed that his grandfather was now too old to be administrator.
Steven said he did not object to stepping down as administrator but only needed a percentage of his late son estate.
“I have no problem stepping down as administrator, but I only ask that the court assists me to also get a share of my son’s wealth as I have not benefitted in any way since he died,” he said.
Chad, however, told the court that he was not happy with the way his grandfather was running the administering father’s estates. He said he was concerned about his grandfather’s age as he was short-sighted and could not handle the pressure of being an administrator.
Chad also claimed that he had heard from other family members that his grandfather was about to sell two houses without his consent.
He said he could not allow that as the two houses were the only source of income for him and his brother who used the rent to pay for their school fees.
Chad also claimed that he did not know the status of other properties such as a farm and two vehicles.
However, Magistrate Mundia Banda adjourned the matter and asked defendant to bring the order of appointment.

Violent hubby faces divorce

A WOMAN of Lusaka’s John Laing Township has sued her husband for divorce claiming that he was a violent man whose brutal actions have traumatised the couple’s children.
Eva Sakala told the court that her husband Paul Zulu was cruel to his children such that they disperse for safety each time he arrived home.
This was in a case in Sakala, 28, sued Zulu, 28, for divorce after irreconcilable difference in their marriage.
Facts before the court were that the two got married in 2004 and have three children together although marital problems emerged in 2008 when Zulu who is a business executive started working.
Sakala submitted before the court that Zulu changed from the time he found employment in 2008.
She claimed that her husband was having affairs with different women and used to spend his salary on them while she was struggling with the children at home.
Sakala said she was forced by the hardships to find a job as a security guard in 2010 but her husband started fighting with her saying she was employed so that she would be sleeping with other men.
“My children are not free in their own parents’ house, my first born even hides knives when my husband comes in to the house for fear that he would kill me and she has heard him threatening to kill me,” she said.
But in his defence, Zulu admitted that he had been cruel but told the court that given a second chance, he was willing to change and become a better person.
He told the court that he was not ready to let go of his wife because he still loved her and wanted to continue staying with her.
He said his children were still young hence he never wanted them to grow in the hands of their step mother or father.
The matter was since adjured to August 22, with the two families urged to sit the couple down and help them to reconcile.

Counsel your children before marriage – court

NDOLA Main Local Court Magistrate Kaala Nyambe has urged parents to teach and counsel their children before they are married off to avoid early divorces.
Ms Nyambe observed that some women were going into marriage without being taught and counselled making it difficult for them to understand issues in marriage.
“Parents should ensure that their female children are taught, if you cannot manage alone organise people that can teach and counsel them. Look at this lady, she was thinking it was right for her to talk to her ex-boyfriend on phone, she does not understand what marriage is,” she said.
Ms Nyambe said this when she was delivering judgment in case in to a 27-year-old man of Pamodzi Township sued his promiscuous 23-year-old wife for divorce.
Laison Nyambe told the court that his wife he has a child with was still having an affair with her ex-boyfriend who was phoning and sending her love messages.
His wife,Carol Lumbeta admitted cheating on her husband saying the relationship with his ex-boyfriend was still going on.
She told the court that she had been visiting the ex-boyfriend and exchanging text messages but only had sex with him once.
Lumbeta pleaded for forgiveness from her husband who refused to take her back and described what had happened in their marriage as a shock.
Ms Nyambe, however, granted the man divorce with no compensation and ordered the two to share the property they bought while they were together
