THE Judicial Complaints Commission (JCC) has said the three Constitutional Court judges were dismissed because they were allegedly not qualified to hold the office of a Constitutional Court (ConCourt) judge.
JCC acting secretary Brian Gombwa also said judges Anne Sitali, Mungeni Mulenga and Palan Mulonda allegedly misconducted themselves during the hearing of the Presidential petition in 2016.
Mr Gombwa said this in an affidavit filed in the ConCourt in response to a petition by Lusaka Constitutional lawyer Tresford Chali who was challenging the dismissal of the three judges.
Mr Chali had argued that the decision of the JCC to recommend for the removal of the three was illegal because only one member of the JCC was qualified to be a commissioner while the rest were not qualified.
